Dissatisfaction with District Court Decision, Evidence of Paul’s Release

Nayak Pal Shah, who is in jail for trial in the case of taxing a minor singer, is going to Pokhara High Court today to appeal against the detention order of Tanahun District Court. The High Court is appealing in Pokhara on Tuesday as the district court’s order to send the accused to jail is not satisfactory.

According to senior advocate Kamal Mohan Wagle, a lawyer representing Paul’s side, he was preparing to go to the high court on Monday. “We could not go yesterday due to lack of time. We are going to the Pokhara High Court today to file an appeal, ”he said.

He said that he was about to file an appeal as the court had remanded Paul in custody despite his demand that the case be tried. The Tanahu District Court’s order to keep him in custody is not legal, missile or factual evidence. We are appealing against the order of the lower court to overturn the order of the district court and get the case on trial as per the legal provisions available in the upper court, ”he said.

After a heated argument between Jaherwala and the defendant, the district court in Tanahu issued a restraining order to send Shah to jail for trial. In a single sitting of District Judge Harish Chandra Dhungana, Pal’s manager Krishna Prasad Joshi has been released on bail of Rs 100,000. After completing the investigation on March 22, the District Police Office, Tanahu had submitted the report to the Public Prosecutor’s Office, Tanahu. On the basis of the report, the government prosecutor’s office had filed a case in the district court Tanahu on March 25.

A complaint was lodged at the District Police Office, Tanahu on February 25 alleging that the singer had been repeatedly teasing her by showing her a false drama.

It is mentioned in the complaint filed by her parents that the last time Shah entered the room of the girl was at 12 pm on April 29, 2078 at the house of Pradip Thapa in Shuklagand Municipality-4, Dulegonda. Paul had surrendered before the Tanahu police on 15 February.

Paul, who is in police custody, has been kept in Tanahu District Jail after the district court ordered him to be remanded in custody for trial. The Pal District Jail is in the B block of Tanahu. There are 140 prisoners in B block with him. Block B has a capacity of 80 people. There are a total of 258 inmates including 13 women inmates in Tanahu Prison.
