Applications can be submitted from June 1st to July 15th
Rome, The inter-ministerial decree was published in the Official news with the modalities for the submission of applications for the emergence of employment relationships of non-EU citizens, Italians and of the European Union, and for temporary residence permit.
The measure was adopted in implementation of article 103 of the decree law of 19 May 2020, no. 34 which provided the possibility:
- for the Italian or foreign employer to sign a new subordinate employment relationship or to declare one illegally established with Italian or foreign citizens present on the national territory before 8 March 2020;
- for foreigners with a residence permit expired on 31 October 2019 to apply for a six-month residence permit.
Two different procedures regulate the submission of applications to the offices of the Ministry of the Interior according to the subjects involved.
There is no click day: applications can be submitted from June 1st to July 15th.
The sectors concerned
- agriculture, livestock and animal husbandry, fishing and aquaculture and related activities;
- assistance to the person for themselves or for members of their own family, even those not living together, suffering from pathologies or handicaps that limit their self-sufficiency;
- housework to support family needs.
The procedures
- At the one-stop shop for Immigration set up in the prefecture: it concerns employers operating in the indicated sectors who request in favor of non-EU citizens.Employers must be Italian citizens, citizens of a Member State of the European Union or foreigners with long-term EU residence permits. For the production sectors agriculture, livestock and zootechnics, fishing and aquaculture and related activities, they must have a minimum taxable income of not less than 30,000 euros. For the sectors of domestic work or personal assistance, the income must be not less than 20,000 euros, in the case of a household consisting of only one income earner, and not less than 27,000 euros, in the case of a household consisting of multiple cohabitants.Foreign citizens must have been photos reported before 8 March 2020, or must have stayed in Italy before that date, as shown by the declaration of presence or documentation of a certain date coming from public or private bodies that, institutionally or by delegation , perform a function or a public attribution or a public service (e.g. medical records, certifications issued by public health companies, registered transport cards etc ..).The requests are presented exclusively by electronic means from 1 June to 15 July 2020 from 7:00 to 22:00 on the application accessible at the address https://nullaostalavoro.dlci.interno.it/using the SPID digital identification system and following the instructions in the user manual available on the same website.There is also a tutorial that will guide users through the compilation of questions.After sending the application, a receipt will be generated on the dedicated portal, personal area, which certifies the presentation of the application to be delivered in copy to the worker.Before submitting the application, the employer must pay the flat-rate contribution of € 500.00 for each worker, using the F24 (REDT 2020) model available at bank branches, post offices or to be downloaded from the Revenue Agency.The One Stop Shop for Immigration, after checking the requests and acquiring the favorable opinions of the police headquarters and the territorial labor inspectorate, will convene the parties for the presentation of the documentation necessary for the emergence and the signing of the residence contract. At the same time, the Help Desk will send the mandatory employment notification and deliver the model for the residence permit application for subordinate work to the worker, which must then be sent to the police headquarters through the competent post offices.Employers will be able to avail themselves of the filling in and forwarding of applications, trade associations, trade union organizations and patronages who wish to provide assistance, free of charge, on the basis of the memorandum of understanding already signed.In order to provide clarifications on the procedures and in response to the most frequently asked questions, frequency ask questions (FAQs) are also being prepared.
- At the police headquarters : irregular foreigners with a residence permit expired on 31 October 2019, not renewed or converted into another residence permit, and who have worked in the sectors indicated before that date, can request the issue of a temporary residence permit, valid only in the national territory, lasting six months from the date of submission of the application.Foreigners will be able to submit their residence permit application to the 5,700 dedicated post offices (friendly counter ) , by submitting the specific application form completed and signed by the person concerned. The service charge is set at € 30.Before submitting the application, the applicant must pay the lump sum payment of € 130.00 to cover the costs for the procedure, using the F24 (RECT 2020) model available at bank branches, post offices or to be downloaded from Revenue Agency website. You must: - be in possession of a passport or other equivalent document or an identity certificate issued by the diplomatic mission of your country of origin; - be present on the national territory on 8 March 2020; - prove that they have carried out work in the areas indicated with documentation to be presented when submitting the application.
- In view of the current phase of health emergency resulting from the spread of the infection from Covid-19, for the first 8 working days, access to the post office "friendly counter" for requests for residence permits will be possible respecting a breakdown by surname . After June 10, the service will be provided without any alphabetical distribution. Upon delivery of the application form for the residence permit at the Sportello di Poste Italiane, the foreigner is issued a receipt containing security specifications that will allow him / her to stay on the national territory and to carry out work in the aforementioned business sectors.At the same time, the foreigner will be summoned to the police headquarters to examine his request and issue a temporary residence permit. The residence permit may be converted into a work permit if the foreigner, within six months, has obtained an employment contract in the production sectors concerned.
